Can Felons Get a Real Estate License?

It depends. Most states evaluate criminal history case-by-case rather than imposing automatic disqualifications. Factors include the type of crime, time elapsed, evidence of rehabilitation, and state-specific rules. Some convictions are disqualifying (especially fraud, theft, or financial crimes); others may not bar licensure.

How States Evaluate Criminal History

Real estate licensing is a state matter. Each state's real estate commission has rules about how criminal history affects licensure. Most states do NOT impose blanket bans — they review applications individually.

Common factors: type of crime, time since conviction, completion of sentence (including probation), evidence of rehabilitation, character references, and the relationship between the crime and the duties of a real estate licensee.

Convictions That Often Cause Issues

Fraud, theft, embezzlement, or other financial crimes — direct relevance to fiduciary duties

Real estate-specific crimes (e.g., mortgage fraud, deed fraud)

Recent felonies with short time elapsed since conviction

Multiple convictions or pattern of dishonesty

Crimes involving moral turpitude (varies by state definition)

Convictions Often Less Problematic

Older convictions (typically 7–10+ years past)

Non-violent, non-financial crimes with completed rehabilitation

How to Apply With Criminal History

Be transparent. Most state applications require disclosure of criminal history. Failing to disclose is itself grounds for denial — sometimes more serious than the underlying conviction.

Submit supporting documentation: court records, completion of sentence, character references, evidence of rehabilitation (employment history, education, treatment completion if applicable). Strong documentation often matters more than the conviction itself.

Some states offer pre-application review — you can submit your record for review before paying for courses. Worth using if available.
